Oohvie Terms of Use
Effective Date: November 3, 2026
Last Updated: November 3, 2026
Operator: HealthLynked Corp.
Website: https://oohvie.com
1. Agreement and scope
These Terms of Use ("Terms") govern access to the Oohvie website, mobile applications, and associated services (together, "Oohvie" or the "Service") provided by HealthLynked Corp. ("HealthLynked," "we," "our," or "us"). By creating an account or using the Service, you agree to these Terms and acknowledge the applicable Privacy Policy and Consumer Health Data Privacy Policy. If you do not agree, do not use the Service. Additional terms may apply to separate HealthLynked services, telehealth consultations, paid subscriptions, purchases, or third-party offerings; where applicable, those terms will be made available in the relevant transaction or service.
Nothing in these Terms limits rights that cannot lawfully be waived, including consumer health data rights or privacy rights under applicable law.
2. Eligibility and account registration
Oohvie is intended for adults age 21 and older. By creating an account, you represent that you are at least 21 years old and legally capable of agreeing to these Terms. You must provide accurate account information, protect account credentials, and promptly notify us of suspected unauthorized account access. You may not impersonate another person or create an account for someone else without lawful authority. We may reasonably verify account eligibility, restrict access, or suspend accounts to address safety, security, fraud, or violations of these Terms, subject to applicable law.
3. Integrated HealthLynked account
Creating an Oohvie account also creates a corresponding HealthLynked account. This enables the user to access available HealthLynked profile and healthcare-connection features, subject to applicable terms and permissions. Account creation is not, by itself, authorization to transfer Oohvie reproductive health records into the user's HealthLynked personal health record or to provide a healthcare professional access to those records.
Menstrual, fertility, contraception, symptom, pregnancy-related, and other reproductive health records entered in Oohvie are not automatically transferred into the user's HealthLynked patient profile. A user may choose to initiate a transfer through the functionality provided. After a transfer, the user separately chooses which healthcare providers may access which information using available HealthLynked controls. Internal account administration and third-party technical processing used to operate Oohvie are described in the privacy policies and are not the same as a user-initiated transfer to their HealthLynked health record.
4. Wellness information, not diagnosis or contraception
Oohvie provides cycle tracking, estimated menstrual and fertility predictions, reminders, educational content, and related wellness features, which may change over time. Such output is statistical or informational, may be inaccurate or incomplete, and does not constitute diagnosis, clinical advice, or a medical recommendation. Actual ovulation and fertile windows can differ substantially from estimates, including with irregular cycles, illness, medication use, hormonal contraception, or incomplete entries.
DO NOT USE OOHVIE CYCLE OR FERTILITY PREDICTIONS TO PREVENT PREGNANCY OR AS A CONTRACEPTIVE METHOD. The Service is not intended to diagnose pregnancy, infertility, or medical conditions, and it does not replace qualified medical care. You are responsible for consulting a qualified healthcare professional about contraception, pregnancy, symptoms, treatment, or medication decisions. For medical emergencies, call 911 or seek immediate medical care.
5. Medication reminders and notifications
If medication or birth control reminder functionality is offered, reminders depend on information you enter, device permissions, network connectivity, operating-system behavior, and the settings you select. A reminder does not establish that a medication was taken. We do not guarantee that a reminder will be delivered, received, or acted on at a particular time. Do not rely on Oohvie as your sole medication-management or emergency-alert system.
6. Optional healthcare services
Where made available, appointment requests, virtual visits, consultations, prescriptions, tests, and related clinical offerings may be provided through HealthLynked or by appropriately authorized healthcare professionals or third parties under applicable professional obligations, consents, and separate terms. Availability is limited by geography, provider availability, and applicable law. Oohvie is not an emergency medical service and does not direct independent clinical judgment. Availability, eligibility, geography, fees, scheduling, and payment options may vary. Material fees and payment requirements, including any applicable HealthLynked points or credits, will be displayed or otherwise disclosed before a transaction is completed. Purchase-specific cancellation, refund, and rewards terms apply to the extent disclosed and permitted by law.
7. Subscriptions, billing, and renewals
Some features may be free and others may require a subscription, purchase, or an applicable HealthLynked service entitlement. Prices, benefits, trial periods, recurring charges, and renewal terms will be presented in the applicable purchase flow. When purchases are processed by Apple, Google, or another independent billing platform, the platform's payment, cancellation, and refund rules may apply. Unless otherwise stated in the transaction terms, canceling a subscription stops future renewal but does not itself delete an Oohvie or HealthLynked account. We may change prices or offerings prospectively with the notice and consent required by law. We do not impose a charge merely by virtue of these Terms; any charge must arise from a purchase or other valid payment authorization.
8. Community features, user messages, and posted content
If forums, discussion groups, messaging, reviews, or similar community features are offered, content you intentionally make public or share with other users may be visible to those recipients, and we cannot control their later use of information they receive. Do not post sensitive reproductive or other health information in public areas unless you intend it to be visible there. You are responsible for lawful content you post. We may moderate, restrict, remove, or preserve content as reasonably necessary to enforce these Terms, protect users, investigate abuse, or comply with law. Your publicly posted material remains yours, but you grant us a limited license to display and administer it within the feature you use; this does not provide unlimited rights to commercialize identifiable consumer health data. Any disclosure of consumer health data through a community function remains subject to required privacy notices and consent.
9. User instructions and information accuracy
You are responsible for the accuracy, completeness, and timeliness of information you submit and for keeping device, account, and notification settings current. Health calculations are based on available inputs, not independent verification. You should independently confirm information material to healthcare decisions. You agree not to submit information you lack the legal right to disclose or attempt to access another person's health information without authorization.
10. User control of transfers and provider access
User-directed transfers from Oohvie to HealthLynked and provider-specific sharing choices are distinct steps. Permission to transfer information to a HealthLynked record does not automatically authorize every provider to view it. Provider access can be managed using available HealthLynked controls, subject to restrictions applicable to information already lawfully received or retained by the recipient. A change or revocation of access generally applies to future availability and does not recall records a provider has already lawfully obtained.
11. Privacy, consent, and sensitive data
Our processing of personal information is explained in the Oohvie Privacy Policy and the Oohvie Consumer Health Data Privacy Policy. Oohvie uses third-party analytics and website-interaction technologies that receive certain health-related activity data, including period-logging, symptom, and birth-control-related events as described in those policies. Such analytics disclosures are distinct from transferring records into a HealthLynked patient health record or sharing selected records with a healthcare provider.
Acceptance of these Terms is not consent to additional collection or sharing of consumer health data where law requires affirmative consent. Separate consent for consumer health data collection and for third-party sharing must be obtained where required unless a statutory exception applies. A choice to transfer records to HealthLynked or grant a healthcare provider access does not, by itself, authorize disclosures to analytics or advertising providers.
We do not market complete consumer health records for direct purchase as a standalone data product. Nevertheless, disclosure to an analytics or technology company may qualify as a "sale" or "sharing" under applicable law even without a conventional cash sale, depending on the recipient's rights and the consideration exchanged. We may not rely on this agreement to waive required privacy authorizations or other statutory rights.
12. Permitted license to user content
You retain any ownership rights you have in information you provide. You grant us and authorized processors a limited, nonexclusive right to host, store, display to you, organize, process, and otherwise use that information only to operate and support services you request and for other purposes permitted by the applicable privacy policies and law. This limited right does not authorize unrestricted sale, marketing disclosure, or independent research use of identifiable consumer health data. We may use aggregated or de-identified information for lawful operational, statistical, and product-development purposes only where the information meets applicable de-identification requirements and safeguards. We will not treat information as de-identified merely because direct identifiers have been removed if it can reasonably be linked to an individual.
13. Intellectual property
The Service, software, names, branding, interfaces, design, content, and underlying technology are owned by HealthLynked or its licensors and protected by applicable law. We grant you a personal, limited, revocable, nonexclusive, nontransferable license to use the Service for lawful, noncommercial personal purposes. No ownership, source code, trademarks, or other intellectual property rights are conveyed except as expressly stated. Suggestions or feedback concerning the Service may be used to improve our products without compensation, but this does not expand our rights to use identifiable consumer health data.
14. Prohibited conduct
You may not misuse the Service; interfere with its operation; bypass authentication, permissions, rate limits, or security; scrape or extract data without authorization; reverse engineer except where law permits; upload malware; violate third-party rights; misrepresent healthcare credentials; use accounts or records without authorization; or use the Service for unlawful, fraudulent, discriminatory, or abusive purposes. We may investigate suspected misuse and take proportionate protective measures, including suspension, preserving evidence, and notifying authorities where legally permitted or required.
15. Service availability and change
We may maintain, repair, modify, discontinue, or replace features, integrations, technical vendors, and service configurations when reasonably necessary for business operations, user safety, security, legal compliance, or product improvements. We do not guarantee uninterrupted access, permanent support for a particular device, or indefinite availability of every feature. Any material change affecting consumer health data categories, purposes, or recipients will be addressed under the privacy policies and applicable consent requirements. We will provide legally required notices and will not use this provision to defeat a consumer's statutory rights.
16. Third-party websites and services
Links to, or integrations with, app stores, healthcare professionals, payment providers, pharmacies, telehealth providers, or other third parties may be governed by their own terms and privacy practices. We are not responsible for third-party acts or omissions to the extent permitted by law. However, this paragraph does not diminish obligations that apply to HealthLynked when it selects or controls a processor of consumer health data.
17. Communications
We may send transactional and security messages necessary for account operation and requested services. Optional marketing communications will be subject to applicable consent and opt-out rights. Device reminders and push notifications may display information to anyone with access to your device; you should configure notification previews and device access appropriately. We may provide legally required notices by email, in-app message, or other lawful means.
18. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE NONCLINICAL SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, OR ERROR-FREE PREDICTIONS. WE DO NOT GUARANTEE MEDICAL, FERTILITY, CONTRACEPTIVE, OR OTHER HEALTH OUTCOMES. THESE DISCLAIMERS DO NOT EXCLUDE ANY WARRANTY OR LIABILITY THAT CANNOT LAWFULLY BE DISCLAIMED, AND DO NOT GOVERN PROFESSIONAL DUTIES OWED BY INDEPENDENT HEALTHCARE PROVIDERS.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEALTHLYNKED AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE NONCLINICAL SERVICE, INCLUDING LOST PROFITS OR BUSINESS INTERRUPTION. TO THE EXTENT A MONETARY CAP IS ENFORCEABLE, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE NONCLINICAL SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HEALTHLYNKED FOR OOHVIE SERVICES DURING THE TWELVE MONTHS BEFORE THE CLAIM OR (B) US$100. THIS SECTION DOES NOT LIMIT LIABILITY FOR MATTERS THAT CANNOT BE LIMITED BY LAW, INCLUDING APPLICABLE STATUTORY PRIVACY RIGHTS, WILLFUL MISCONDUCT, OR OTHER NONWAIVABLE CLAIMS. ANY CLINICAL CLAIMS ARE GOVERNED BY APPLICABLE LAW AND THE RELEVANT PROVIDER RELATIONSHIP.
20. Indemnification
To the extent permitted by law, you agree to indemnify HealthLynked against third-party claims arising directly from your unlawful misuse of the Service, unauthorized access to another person's records, infringement of third-party rights, or material breach of these Terms. This obligation does not require you to indemnify us for our own negligence, breach of statutory duties, or misconduct to the extent prohibited by applicable law.
21. Suspension, termination, and deletion
You may stop using Oohvie at any time and request deletion through the privacy procedures. We may suspend or terminate access when reasonably necessary for safety, security, fraud prevention, nonpayment of applicable charges, or material violations of these Terms, subject to applicable law. Closure or deletion of an Oohvie account does not necessarily close the associated HealthLynked account; the policies and account deletion process must explain both. Health information previously transferred to a HealthLynked record or lawfully received by a provider may be subject to separate deletion rules and permitted retention obligations.
22. Governing law and disputes
Except where applicable law provides otherwise, these Terms are governed by Florida law, without regard to conflicts-of-law rules. Courts of competent jurisdiction in Collier County, Florida will be the agreed venue for disputes to the extent a venue provision is enforceable. This section does not restrict nonwaivable statutory remedies, a consumer’s right to exercise privacy rights, or jurisdiction and venue required by applicable law.
23. Assignment, severability, and entire agreement
HealthLynked may assign these Terms in connection with a merger, acquisition, reorganization, sale of substantially all relevant assets, or other lawful transfer of the Service, subject to applicable privacy laws, notice, and consent requirements. You may not transfer your personal account or rights under these Terms without our consent, except where law provides otherwise. If any provision is held unenforceable, the remainder will remain effective to the extent lawful. A failure to enforce a provision is not a waiver. These Terms, together with any expressly applicable service-specific terms, form the agreement governing the nonclinical Service; our privacy policies separately describe data practices and are not a waiver of privacy rights.
24. Changes and contact
We may revise these Terms prospectively. We will provide notice of material revisions when required and obtain renewed consent where applicable law requires it. The current version and effective date will be posted on the Oohvie website. Questions about these Terms may be directed through https://oohvie.com/contact/. Privacy requests may also be directed to [email protected]. Please do not include sensitive medical information in ordinary, unsecured email.
